Minimizing the Income Tax on the Receipt of Lump-Sum Social Security Benefits

Sometimes a taxpayer will receive Social Security benefits in one lump sum. A taxpayer might have to pay income taxes on up to 85 percent of these benefits. However, a taxpayer may make an election under Section 86(e) of the Internal Revenue Code to minimize the income tax on the receipt of the lump-sum Social Security benefits.

Why would a taxpayer receive lump-sum Social Security benefits? A taxpayer could have been receiving Supplemental Security Income (SSI), which is tax free. Then, the Social Security Administration determines that the taxpayer should have been receiving Social Security disability benefits for the last several years instead of SSI. Another reason that a taxpayer could receive Social Security benefits in one lump sum is that the Social Security Administration may have initially denied the individual's application for Social Security disability benefits, but the individual wins those benefits on appeal.

Social Security benefits are not taxable for taxpayers with relatively low amounts of adjusted gross income. At moderate levels of adjusted gross income, 50 percent of the Social Security benefits are taxable. At high levels of adjusted gross income, 85 percent of Social Security benefits are taxable.

This graduated system for including Social Security benefits in gross income and the progressive nature of income tax rates can have a very bad effect on individuals who receive lump-sum Social Security benefits. Such individuals might have to pay a much larger amount of income taxes than they would have if they had received the Social Security benefits when they should have received them. If the taxpayer does not take action to make an election allowed by Section 86(e) of the Internal Revenue Code, that is what will happen.

Sometimes the taxpayer does not receive any cash for the lump-sum payment. For example, if the taxpayer had been receiving SSI and the Social Security Administration determines that the taxpayer should have been receiving Social Security disability benefits, the Social Security Administration will reduce the disability benefits by the amount of the SSI paid to the taxpayer. The taxpayer will receive a Form 1099-SSA showing the amount of the lump-sum Social Security disability benefits and yet the taxpayer received little, if any, cash.

Section 86(e) of the Internal Revenue Code allows a taxpayer who receives lump-sum Social Security benefits to elect to include in gross income only the sum of the Social Security benefits that the taxpayer would have included in gross income in prior years if the taxpayer had received the benefits in the years to which the lump-sum payment is attributable. A taxpayer may also make the election if the taxpayer received Railroad Retirement benefits in one lump sum.

Section 86(e)(2)(B) states that the taxpayer should make the election in the manner prescribed by the Secretary of the Treasury in regulations. However, the Secretary of the Treasury has not issued any regulations under Section 86. Once a taxpayer makes the election, the taxpayer may not revoke it with the consent of the IRS.

Because no regulations exist that prescribe the manner of the election, a taxpayer should make the election according to the guidance the IRS provides in IRS Publication 915, "Social Security and Equivalent Railroad Retirement Benefits." IRS Publication 915 has helpful worksheets and other information about making this election. Taxpayers who received Social Security benefits or Railroad Retirement benefits in one lump sum should consult IRS Publication 915 and determine whether the election will reduce their taxes.

The Benefits of Using a Mortgage Broker

Buying a house can be complicated enough, but trying to sort out which mortgage is best, what the different rates are, etc, can be like trying to pick your way through a minefield. That's why using a mortgage broker is such a good idea, and one that more and more home buyers are starting to do.

Whereas previous generations of home buyers were content to simply arrange the mortgage through their banks, today's buyers are different. With the Internet offering new ways for people to look for deals on everything from home insurance to car loans, mortgage lenders are no longer the ones in control. However, using a mortgage broker is still more advisable than looking for offers by yourself.

Why a Mortgage Broker?

A mortgage broker is a certified professional and someone who has spent years training to become an expert in mortgages. Regulated by the Financial Services Authority (FSA), they have a strict set of guidelines that they must adhere to. This includes the information they give you, and the ethical decisions they make regarding any financial advice they provide to you.

Because of this, they are usually independent, which offers the potential home buyer the benefit of unbiased advice. Even if a broker belongs to a company, you should still be offered a greater choice when it comes to the type of mortgage you take out, as well as whom you take it out with. Compare this to banks and building societies, which usually try and arrange your mortgage solely with them, and the extra cost in using a broker are more than worth it.

What does a Mortgage Broker do?

Because they are such experts in their field, a mortgage broker can offer a host of services that you may not have received otherwise. As well as their advice, you can also expect a broker to:

Find the mortgage that's right for you
Access to thousands of different lenders nationwide
Provide a "mortgage calculator" that will help you decide how much you can borrow
Explaining the different mortgages - fixed rate or variable, self-certification or ad credit mortgage, etc

These are just some of the basic services that a broker can offer you. They can also help you arrange the best survey companies to use, close your paperwork, arrange legal fees and advice - pretty much anything connected with a mortgage, a broker can help you with. Additionally, a mortgage broker can also advise you on what additional costs you should include - for example, mortgage protection insurance and why you need it.

One of the biggest reasons many home buyers are put off using a mortgage broker is because of the extra cost involved - after all, they're already spending thousands on the property itself. However, the extra cost can often be included within the mortgage itself, and even if it's not, the few hundred pounds you spend on a broker's expertise could save you thousands in the long run.

If you're looking to buy a house soon, or even re-mortgage an existing property, speaking to a mortgage broker could save you more than you think, and is well worth the time and cost involved.

Benefits of a Fixed Rate Home Equity Line of Credit

A fixed rate home equity line of credit gives you easy access to low interest credit. It also provides you with stability, helping you know how much your rates will always be. The greatest savings can be seen over time if rates increase. So, even if you don't plan on using that credit line now, it may be a good idea to keep it open for the future.

Easy Access to Low Interest Line of Credit

With your home's equity as your collateral, you can qualify for low rates with a home equity line of credit. Compared to other sources of credit, you will find it hard to secure a better rate on credit, and interest paid is deductible from your taxes in most cases.

Unlike an equity loan, you can access your credit when you need it. Usually a debit-like card is issued to you from the lender. You can use it like a credit card.

Fixed Interest Rates Offer Long Term Stability

Fixed rates provide a borrower with stability, always knowing what their rates will be. This is especially good when rates are low. However, adjustable rates may initially be low. In some cases, rates can even drop.

Fixed rates are for those that want the security of a permanent rate. While not without risk, fixed rates can give peace of mind. Remember too that with most lenders you can either convert or refinance your line of credit to an adjustable rate in the future.

Long Term Savings with a Fixed Rate Line of Credit

For long term debt, a fixed rate can potentially see an interest savings for borrowers. By locking in a low rate now, you will see a savings if rates rise. Over the long term, this could save you some significant cash.

With a line of credit, you don't have to use it. So if rates are significantly low, consider opening an account to use in the future when/if rates are higher. You always have the option of closing the account if rates are high and opening one with lower rates.

Before applying for credit, be sure to compare both rates and fees to find the most competitive financing package.
